1. Acceptance of Terms

By accessing or using the Hookya AI platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms constitute a legally binding agreement between you and Hookya AI ("we," "us," or "our").

2. Description of Service

Hookya AI is a platform that uses artificial intelligence to generate influencer-style video advertisements. Users can input product details, select hooks, and configure video parameters to produce short-form video ads suitable for platforms like TikTok, Instagram Reels, and Meta Ads.

3. Account Registration

To use the Service, you must register an account using a valid email address. We use a passwordless authentication system that sends a one-time passcode (OTP) to your email. You are responsible for maintaining access to your email account and for all activities that occur under your account.

4. Subscription Plans and Billing

We offer the following subscription plans:

• Starter — $49/month: Includes a set number of video credits per month for individuals and small teams getting started.
• Growth — $99/month: Increased video credits and additional features for growing businesses scaling their ad production.
• Scale — Custom pricing: Tailored plans for agencies and enterprises with high-volume needs. Contact us for details.

Subscriptions are billed on a recurring monthly basis. You may cancel your subscription at any time, and your access will continue until the end of the current billing period.

5. Content and Intellectual Property

You retain full commercial rights to all video content generated through the Service using your account. You may use generated videos for advertising, marketing, social media, and any other lawful commercial purpose without restriction.

You are solely responsible for ensuring that the product information, claims, and content you provide as input comply with applicable advertising laws and regulations. We do not review generated content for legal compliance.

6. Acceptable Use

You agree not to use the Service to:

• Generate content that is illegal, defamatory, obscene, or promotes violence or hatred
• Create misleading or fraudulent advertisements
• Infringe upon the intellectual property rights of others
• Attempt to reverse-engineer, decompile, or otherwise extract the underlying AI models or technology
• Interfere with or disrupt the Service or its infrastructure
• Share your account credentials or allow unauthorized access to your account

7. Platform Compliance

Videos generated through our Service are intended for use on advertising and social media platforms including but not limited to TikTok, Instagram, Facebook, and YouTube. You are responsible for ensuring that your use of generated content complies with the terms and advertising policies of each platform where you publish it.

8. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any losses resulting from service interruptions.

9. Payment Terms

All payments are processed securely through our third-party payment provider. Prices are listed in US Dollars (USD). By subscribing, you authorize us to charge your selected payment method on a recurring monthly basis.

Refunds may be issued at our discretion on a case-by-case basis. Unused video credits do not carry over between billing periods and are non-refundable.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Hookya AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the Service.

Our total liability for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

11. Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms or engage in conduct that we determine, in our sole discretion, to be harmful to the Service or other users. You may terminate your account at any time by canceling your subscription and contacting us.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
